
An Upper Area Court II sitting in Yola on Monday docked an officer of the Nigeria Immigration Service (NIS), Adamawa State Command, Daniel Daniran David, over allegations of public nuisance, assault and related offences.
The presiding judge, Mr. Japhet Ibrahim Basani, docked the officer following a direct criminal complaint lodged before the court by Yusuf Adamu Ziradzo and his wife, Precious Ndogolare Yusuf, through their counsel, Mr. H. E. Turaso.
David was charged under sections 153, 167, 217, 240 and 241 of the Adamawa State Penal Code Law for offences bordering on public nuisance, negligent conduct, hurt, criminal force and assault.
According to the complainants, they reside in the same compound with the defendant at Jifiya Suits in Jimeta, Yola North Local Government Area.
They alleged that on Sept. 6, between 1 a.m. and 2 a.m., the wife had closed the main gate of the compound after noticing it was left open. When the defendant returned and discovered the gate had been locked, he reportedly confronted her to know who closed it and was told it was her.
The complainants further alleged that the defendant then went to their window and sprayed tear gas into their apartment while they were sleeping with their four children.
They said the family rushed to the hospital for treatment after the children were choked, coughing and sneezing, adding that the incident left them traumatised.
When the charges were read to the defendant, he pleaded not guilty.
Defence counsel, Mr. D. S. Adebole, applied for bail, assuring the court that the defendant had reliable surety.
The judge granted the application, admitted the defendant to bail and adjourned the matter until Sept. 25 for report of settlement or commencement of hearing.
